No action against tobacco sellers till the next date of hearing – Delhi High Court

Tobacco Sellers Feels relief after the notice of High Court issued a notice that no action against tobacco sellers untill next hearing

The Delhi High Court on Wednesday looked for reaction of the city government on a request of producers against boycott at a bargain of chewable tobacco in the national capital from March 30, 2015.

Justice Rajiv Shakdher issued notice to Food Safety Commissioner of the Delhi that No action will take against tobacco sellers till the next date of hearing i.e on May 20 2015.

“Issue notice. The respondent should not take any coercive action on the sellers and the manufacturers till the next date of hearing,” the judge said.

The court’s notification was issued on a supplication by a producer Sugandhi Snuff King, which has looked for suppress of the notice by the Arvind Kejriwal government, banning sale, purchase and storage of all forms of chewable tobacco including “gutkha, khaini and zarda” in the national capital.

The counsel further stated that Sugandhi Snuff King was manufacturing a pure tobacco product governed by Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003.

The manufacturer also said only the Centre has the power to regulate sale or ban and not the State government.

The producer moved the High Court after the Delhi government on March 27, 2015 had declared the boycott discounted, buy and capacity of chewable tobacco in the city.
